Uchunguzi wa wanazuoni umebaini kuwa mara nyingi binadamu anaweza kuficha tabia yake au kusema kile anachokifikilia ila ni agharabu kufanya hivyo hasa pale anaposhindwa kudhibiti hisia zake iwe ni furaha, msongo wa mawazo au hata gadhabu, Kauli ya mtu uonyesha taswira ya tabia ya mtu mwenyewe.

Hakuna mtu mwenye akili timamu ambaye anaweza kushabikia Maafa yaliyotokea Mtwara kwa kupoteza ndugu zetu pamoja na mali, Ila Mwenye busara lazima ajiulize ni kwanini watanzania wapenda amani wamefikia hatua ya kujikusanya kwa mamia kuhami kile ambacho wanafikiri ni haki yao na sasa wana dhulumiwa?

Sakata hili limetuma salamu vilevile kwa wanahabari, kitendo cha wanahabari kuwa miongoni mwa walengwa kutokana na kazia hiyo inatoa tafsiri ya wananchi kuanza kuchoshwa na wanataaluma wenye kucheza na hisia za watu kuwa siku zao nazo zinahesabika.

Naungana na Magazeti pendwa yote yaliyo onyesha uzalendo wa hali ya juu kwa kutoa nafasi kwenye kurasa zao za mbele kuweka tahariri ambazo zilikuwa na lengo la kuleta maelewano baina ya pande mbili za watawala na watawaliwa hususana wa Mtwara siku ya Ijumaa Mei 24, 2013. Ingawa nachelea kusema kauli hizo zimekuwa za upande mmoja tu.

Nachukuwa nafasi hii kuwahasa wanahabari kuwa Uzalendo halisi ni kuwa na nia ya dhati kutoa changamoto kwa serikali hasa wakati ambapo haijatimiza majukumu yake.

Nakumbuka maneno ya Muungwana mmoja aliye julikana kama Theodore Roosevelt pale alipo nukuliwa akisema “Maana ya Uzalendo ni kusimamia yale yote yenye masilahi ya nchi, lakini siyo kumuunga mkono rais au kiongozi yeyeto wa serikali.”

Watawala wanapaswa wakubaliane na hali hii kwa kuketi chini na kuitafutia ufumbuzi. Kwanini haya yanayotokea sasa na si wakati mwingine wowote tangu nchi hii ipate Uhuru wake zaidi ya miaka 50 iliyopita? Kila Mtanzania kwa sasa anashuhudia matukio yasiyo ya kawaida ambayo hatukuwahi kuyashuhudia wala kuyatarajia kutokea hapa kwetu.

Hali ni tofauti kwa viongozi wetu ambao kila uchweo hawaachi kubembeleza kwa wananchi kuwa kuuliza “hamuoni tunayofanya” na kuwa watu wanalaumu tu lakini hawatoi pongezi kwa “mazuri mengi waliofanya”. Imefika mahali watawala wanawashanga watawaliwa kama ambavyo watawaliwa wanavyo washanga watawala.

Tukio la Mtwara siyo la bahati mbaya, wala tusijidanganye kwa kusema limechochewa, na kuwapa wananchi majina kama ya wahuni au kufika mbali kwa kuwaita vibaka.

Tunahitaji muda wa kutafakari na kukubali kuwa watanzania wa sasa siyo wa miaka hiyo na wamepoteza imani na watawala ambao wemekwenda mbali hata kuthubutu kuwa fananisha na chura kwa kujiaminisha kuwa kelele zao kamwe haziwezi zuia bomba la gesi kwenda Dar.

Watawala wetu wamebakia kutumainia vitisho, dharau na matumizi ya nguvu. Wameshindwa kabisa kujenga hoja – kwa mfano kwenye hili suala la gesi.

Hawana ushawishi wa hoja na badala yake hata kauli zao wanazotoa zimejaa dharau (contempt) na matokeo yake watu nao wanawadharau! Wanafikiri vitisho na kejeli zinajibu hoja.

Najuwa wengi wataniita mchochezi, lakini jaribu kufikilia dharau ambayo imeonyeshwa waziwazi na Waziri wa Nishati na Madini Prof. Mhongo, nahii siyo mara moja. Jumanne ya tarehe 21 Mei 2013 aliwafananisha Wanamtwara na chura.

Alhamisi tarehe 23, Mei 2013 katika mahojiano na Idhaa ya Kiswahili ya Ujerumani DW mchana  alinukuliwa akisema kwamba katika sakata hili wananchi wanadanganywa na kutumiwa kwani wao hawana uwezo wa kupiga hesabu ya faida au hasara ya usafirishwaji wa gesi kutoka Mtwara kwenda Dar es Salaam.

Kwa maneno machache anawaona wananchi wa Mtwara kama Mazuzu wasiyokuwa na uwezo wa kujifanyia maamuzi, kwa fikra zake kupiga hesabu ndogo kama hiyo ni lazima uwe ni Profesa.

Ni wazi tuna tatizo! viongozi wetu wamekosa ushawishi (are out of touch) kabisa!

Napingana na hoja zinazosema kuwa watu wa Mtwara au watanzania wengine popote pale wanahitaji kuelimishwa. Viongozi ndio wanatakiwa warudi kwa wananchi ili wananchi wawafundishe ni nini cha kufanya.

Ni lini huyu Profesa alikutana na wananchi wa Mtwara, akaongea nao na kujiridhisha kuwa hawana huo uwezo anao uongelea? Kwanini huyu Profesa anarudia kebehi zile zile?

Watawala wetu wanaona zaidi hili la ‘Uchochezi, uhuni na kuwaita wana mtwara vibaka’ kuliko kiini hasa cha tatizo? Kwanini tusijifunze kutatua matatizo kwa kushughulika na kiini badala ya kungagana na Viashiria (symptoms) kila siku?

Inashindwa kuingia akilini pale viongozi wetu wanaposhindwa kwa makusudi kushughulikia tatizo linalojulikana wazi na kuanza kutafuta mchawi!

Amiri Jeshi wetu mkuu akiwa kwenye mkutano wa Dodoma huenda kwa kushauriwa vibaya alitaharuki na kunukuliwa akisema “atawasaka wachochezi popote walipo na hata kama wanapembe basi watazikata”.

Sina nia ya kupingana na kauli ya rais wangu bali namkumbusha kuwa pembe ni kama kucha ukizikata uwa zina tabia ya kuota hivyo utakuwa bado ujatatua tatizo.

Kauli ya Amiri Jeshi wetu mkuu ilifwatiwa na kupelekwa kwa askari wa JWTZ Mtwara.

Ufahamu wangu mdogo unanituma kujuwa matumizi ya vijana wetu wa JWTZ utumika wakati wa hali ya hatari au kulinda mipaka yetu, Ila siku za hivi karibuni tumeshuhudia matumizi ya jeshi hili katika mambo ya kisiasa.

Taarifa za awali zinadai zaidi ya wanajeshi 300 tayari wako Mtwara, ukiniuliza kufanya nini sina jibu la moja kwa moja!

Je! vikosi vya kutuliza ghasia vya polisi vimezidiwa nguvu na wananchi wasiyokuwa na silaha mpaka kuliingiza jeshi kufanya kazi za polisi!

Naomba ifahamike kuwa vijana wa JWTZ mafunzo yao siyo kwa ajiri ya kulinda amani maeneo ya raia ndiyo maana sijashanga shutuma ambazo tayari zimeanza kutolewa za uvunjwaji wa haki za binadamu dhidi yao.

Nakumbusha tu, Sudan ya Kusini ilizaliwa baada ya Sudan kudharau madai ya Muda Mrefu ya Sudan ya Kusini. Elimu na Hekima, huzaa Maelewano na Upendo na Ustawi wa Jamii yenye Amani ya Kweli. Elimu na Sheria visivyo na Hekima , huzaa viongozi Viziwi,Vibubu na Vipofu wa Fikra na matokeo yake hupoteza Amani, Wananchi wasio sikilizwa maoni yao, huona bora kuwa kama Sudan ya Kusini.

Suluhu ya jambo si matumizi ya nguvu na kubeza. Suluhu ya jambo ni kutumia hekima na busara. Suluhu ya jambo ni kusikiliza na kujua hoja zinazopelekea wananchi kupinga jambo hili. Suluhu ya jambo hili ni kufanya utafiti wa kina kujua kiini na kushughulikia tatizo hilo kikamilifu.

Bila kujua kiini, tatizo hili halitaisha wala kuondoka.

Mwisho, napenda kutoa pole kwa familia za wale waliofiwa, walioumia na kuharibiwa mali zao.

Tanzania imekuwa ni nchi ya amani na utulivu, sote tuna wajibu wa kulinda amani hii na kuidumisha.

4TH TANZANIA OFFSHORE AND NORTH LAKE TANGANYIKA LICENSING ROUND: THE GOVERNMENT MUST ACT STRATEGICALLY AND RESPONSIBLY

Fellow country men and women, the announcement posted by the Government of the United Republic of Tanzania through Tanzania Petroleum Development Corporation (TPDC) last week for the 4th Tanzania Deep Offshore and North Lake Tanganyika Licensing Round at this juncture triggers serious concerns amongst civil society organisations in Tanzania.

While commending the government for ongoing efforts to put in place robust policies and laws governing the petroleum sector; we, the undersigned are particularly concerned that the move to issue new licenses is neither strategic nor in the interests of the nation. Rushing into licensing the blocks amidst the process of developing and or reviewing key policies, laws and institutions responsible for the management of the sector is misguided. The government ought to understand that Tanzania as a country is at the very early stages of the learning curve as far as management of oil and gas industry is concerned.

Lack of clarity on the intended policy objectives: We take note that last year’s announcement of the 4th offshore licensing round was postponed awaiting the Natural Gas Policy to be finalized. The assumption was that the new policy will increase opportunity for the country to benefit from the sector, while reducing possible negative impacts. For maximum benefits to be achieved, policy choices have to be made before licensing rounds start. The terms and conditions during the licensing rounds reflect policy directions and commitments to be achieved from issuance of exploration blocks. The 4th licensing round announcement basically takes us back, putting doubts as to who is really pushing this process. Is it in the country’s interest or is it industry that is on the driving seat?

Controlling the tempo: The speed at which Tanzania is allocating blocks on its continental shelf undermines the objective and logic behind maximizing benefits for the country. It is of utmost importance to organize the petroleum sector in a way that leaves the country with the opportunity to gain experience and control over time. It is not sensible to issue so many blocks, so fast and so close to each other, at a time when we acknowledge having little technical and monitoring capacity. For a young gas producing country like Tanzania, moderate growth and careful issuance of blocks is key to achieving maximum value through gradual competence enhancement.

It also gives room for the smooth development of infrastructure for gas transportation, processing and marketing. Deep water discoveries require efficient infrastructural setup, ensuring quality control and monitoring. If so many blocks are issued at once, it will be difficult to have a focused work plan given the existing limiting infrastructure. This could lead to
losses, wastage and gas flaring endangering the marine life.

Has the bidding round for offshore blocks already started? Last year TPDC said it would release the Bid Round Data Package (BRDP) for offshore blocks by the end of September. This includes the vital seismic data on which companies base their bids. Was the BRDP released? If so, the offshore licensing round has effectively already begun.

Lack of transparency on how the new blocks will be awarded: The criteria by which bids will be judged should be made public. These may include issues such as signature bonus, production bonus, and minimum level of state participation to be offered by companies. Similarly, the basic fiscal terms governing Production Sharing Agreements (PSAs) should be published if we are serious about improving the management of our natural resource wealth.

Separation of roles -TPDC and the regulator mystery: TPDC is still acting as a regulator and promotion arm of the government for the sector, however in the announcement for the 4th licensing round set out blocks 4 1/B and 4 1/C
for itself. This should be the function of the regulator (currently non-existent) who is mentioned in the draft Gas policy. Involvement of TPDC in the licensing process and allocating blocks, if unchecked, undermines the current reforms in the petroleum sector.

What happened on Lake Tanganyika? Total was announced to have won the Lake Tanganyika licensing round in July 2011 but the Production Sharing Agreement (PSA) was never signed. The Ministry of Energy and Minerals have never told the nation what went wrong after the competitive bidding process. The nation needs to know what happened. Is it a case of lack of due diligence on the capacity and commitment of the bidding parties or incompetence on the regulator? And what lessons can we learn from this process?

Constitution debate and sovereignty issues: As we are in the middle of the re-writing of our constitution, questions arise around ownership of the resources, transparency in revenue management and distribution of benefits. Tanzanian people feel that the country does not benefit enough from petroleum operation. There is also need to fully resolve Zanzibar’s call for control of the deep water petroleum operations. The continuous licensing of deep water blocks only increases anxiety and tension amongst citizens.

To this end, we call upon:
•    The parliament of the United Republic of Tanzania to firmly exercise its constitutional mandate to represent the views of the people and interest of the people of our beloved motherland Tanzania to check the dangerous speed with which the government intends to move.  Past experience in mining sector governance should have provided us with invaluable lessons to avoid mistakes. Tanzania must avoid falling under the resource curse.
•  The government to put national interest at the fore and deter any unwarranted pressure from Multinational Corporations. East Africa is the new frontier for oil companies operating globally. Their desire to open up new acreage should not come at the cost of our need to improve the management of our natural resource wealth.
•    The government to heed its call for open governance. Transparency helps reduce the likelihood that officials will negotiate detrimental deals with industry and creates a more conducive and predictable investment climate. But most important of all, transparency helps dispel any fears and suspicion on the part of citizens that their resource wealth is being abused.

Rais wa Jamhuri ya Muungano wa Tanzania, Mheshimiwa Jakaya Mrisho Kikwete amelaani vikali fujo na ghasia zilizofanyika mjini Mtwara jana, Jumatano, Mei 22, 2013, akisisitiza kuwa raslimali yoyote inayopatikana katika sehemu yoyote ya nchi yetu ni mali ya Watanzania wote na lazima itumike kuwanufaisha wote.

Rais anaamini kuwa ni jambo lisilokubalika kuwa raslimali ya nchi inaweza kuzuiliwa isitoke katika eneo ambako inapatikana kwa vile hakuna nchi yoyote duniani inayoruhusu jambo la namna hiyo. Nchi hiyo haipo na wala sera za namna hiyo haziwezi kuanzia Mtwara.

Aidha, Rais anasisitiza kuwa Sera ya Serikali ni kwamba kila mtu, kila Mtanzania anayo haki ya kunufaika na raslimali ya nchi yetu yakiwemo maeneo ambako inatoka raslimali.

Rais Kikwete haoni sababu yoyote ya msingi ya kufanyika kwa fujo na ghasia za Mtwara. Fujo hizo hazina kichwa wala miguu, hazina mshiko na wala waliofanya fujo hizo hawaelezi wanataka nini isipokuwa kuhitimisha nia na dhamira yao ya kufanya fujo na kuharibu bila sababu mali za wananchi na zile za taasisi za Serikali.

Itakumbukwa kuwa wakati zilipotokea fujo na ghasia kwa mara ya kwanza mwanzoni mwa mwaka huu, Waziri Mkuu Mheshimiwa Mizengo Pinda alikwenda Mtwara akakutana na akazungumza na makundi mbali mbali na wananchi wa Mtwara. Ilionekana kama ulikuwa umepatikana mwafaka wa kuhakikisha kuwa jambo hilo halitokei tena.

Katika mazungumzo hayo, Mheshimiwa Pinda aliwaelezea kwa undani kabisa fursa nyingi zinazowasubiri wananchi wa Mtwara kwa sababu ya ugunduzi wa gesi asilia na mipango ya Serikali kuhakikisha kuwa Mtwara na maeneo jirani yananufaika. Miongoni mwa mambo mengine, Mheshimiwa Pinda aliwaeleza yafuatayo:

(a)           Kwamba kiasi cha viwanda 57 vya shughuli mbali mbali vitajengwa Mtwara ili kuhudumia shughuli za uzalishaji wa gesi asilia na maendeleo ya uchumi wa Tanzania kutokana na gesi asilia hiyo. Idadi hii ya viwanda haijapata kujengwa katika eneo lolote la nchi hii katika historia.

(b)          Kwamba kiasi cha gesi asilia ambacho kitatoka Mtwara kusafirishwa hadi Dar es Salaam kwa shughuli nyingine za kitaifa ikiwamo kufua umeme ni asilimia 14 tu, na kuwa kiasi kinachobakia cha asilimia 86 kitabakia Mtwara kwa ajili ya kuzalisha huduma mbali mbali na kuhudumia idadi hiyo kubwa ya viwanda.

Isitoshe, Rais anajiuliza kuwa kama gesi asilia isipotoka Mtwara itabakia huko inafanya nini kwa sababu bidhaa yoyote ni lazima ifikishwe sokoni ili iweze kuuzika. Gesi asilia hiyo ikibakia katika eneo la bahari la Mtwara itawafaisha vipi wananchi wa Mtwara hata kama wakifanya fujo kila siku?

Rais Kikwete anawakumbusha wafanya fujo wa Mtwara na vinara wa fujo hizo kuwa Serikali inao wajibu wa kulinda usalama wa wananchi pamoja na usalama wa mali zao. Hivyo, Rais Kikwete hakubali fujo na ghasia zilizofanyika Mtwara leo. Anazilaani vikali na wala hatakubali wafanya fujo wachache kuvuruga amani na usalama wa nchi yetu popote walipo na kwa kisingizio chochote kile iwe ni kutafuta umarufu wa kisiasa ama kulinda maslahi binafsi ya kibiashara.

Serikali itawasaka na kuwakamata wote walioshiriki katika fujo za leo na kuwafikisha mahakamani. Aidha, Serikali itawasaka na kuwakamata viongozi na vinara wa fujo na ghasia hizo na kuwafikisha mbele ya sheria hata kama wana mapembe makubwa kiasi gani.

Rais Kikwete anawapa pole sana wananchi wa Mtwara ambao wameathirika binafsi kwa kuumizwa ama mali zao kuharibiwa katika fujo na ghasia za leo. Anapenda kuwahakikishia kuwa Serikali yake itachukua hatua za kukomesha vitendo hivyo vya fujo na ghasia katika eneo hilo.
